DEM Earth – End User License Agreement CinemaPlugins.com – Last updated: Dec 2025
This End User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single legal entity) (“Licensee” or “you”) and CinemaPlugins.com(Paul Everett), whose registered office is 37688, Beverungen,Germany (“Licensor”, “we”, “us”). By installing, copying, or otherwise using DEM Earth (the “Software”), you agree to be bound by the terms of this Agreement.
1. Grant of License 1.1 Subject to your compliance with this Agreement and payment of all applicable fees, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable license during the Term to install and use the Software in object-code form only, solely: (a) in accordance with the license type you purchased (Node-Locked Single-User, Floating Single-User, or Floating Multi-User – “License Type”); and (b) for your own internal business purposes or personal use.
- 1.2 Node-Locked Single-User License: Use is restricted to one specific computer only and is permanently node-locked to that machine. No transfers to another computer are permitted under any circumstances.
- 1.3 Floating Single-User License: Use on one computer at a time. You may move the license between computers provided you release it properly via the built-in license manager(see plugin prefs).
- 1.4 Floating Multi-User License This license permits concurrent use by up to the exact number of seats purchased. The Software may be installed on no more than twice the number of purchased seats (e.g., 2 seats → maximum 4 installations; 5 seats → maximum 10 installations). In all cases, simultaneous use must never exceed the number of seats purchased. Any installation beyond this limit, or any concurrent use beyond the purchased seats, is a material breach of this Agreement.
2. Restrictions You may not (and may not allow any third party to): (a) copy the Software except for one backup/archival copy; (b) modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable law expressly prohibits this restriction), or create derivative works; (c) remove or alter any copyright, trademark, or other proprietary notices; (d) use the Software in any manner that violates third-party rights or any applicable law; (e) use the Software on any service-bureau, time-sharing, or similar basis; (f) circumvent or attempt to circumvent any license key, activation mechanism, or usage restrictions.
3. Ownership & Third-Party Data 3.1 The Software and all copies are licensed, not sold. Licensor and its licensors retain all right, title, and interest in the Software and all intellectual property rights therein. 3.2 The Software may download or display third-party geographic data, imagery, or elevation data (“Third-Party Content”). You receive no ownership or license rights in Third-Party Content. Your use of Third-Party Content is subject to the applicable third-party terms (e.g., Google, Bing, OpenStreetMap, etc.). Licensor is not responsible for Third-Party Content.
4. Maintenance & Support 4.1 Each new license purchase includes 12 months of Maintenance & Support from the date of first activation. 4.2 Maintenance & Support entitles you to: (i) minor updates and bug fixes, (ii) major version upgrades within the purchased major version family(i.e. R5 cycle), and (iii) technical support via helpdesk. 4.3 After expiration, you may renew Maintenance & Support at the then-current price. Certain online features and data services require active Maintenance & Support.
5. Termination 5.1 This Agreement is effective until terminated. 5.2 Licensor may terminate immediately if you breach any term. 5.3 Upon termination, all license rights end and you must immediately cease using the Software and destroy or delete all copies.
6. Limited Warranty & Disclaimer 6.1 Limited Warranty Licensor warrants that, for a period of ninety (90) days from the date of purchase (“Warranty Period”), the Software will substantially conform to its published documentation when properly installed and used on a supported system. Your exclusive remedy, and Licensor’s entire liability, for any breach of this warranty shall be, at Licensor’s option, either (i) repair or replacement of the Software, or (ii) refund of the license fee paid. This warranty does not apply if the defect results from accident, abuse, misapplication, or Third-Party Services (as defined below).
6.2 Disclaimer of All Other Warranties EXCEPT FOR THE LIMITED WARRANTY IN SECTION 6.1 ABOVE, THE SOFTWARE, SUPPORT, AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND. LICENSOR AND ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
6.3 No Warranty or Liability for Third-Party Services and Content The Software may rely on or interact with third-party services, APIs, data providers, or content (including but not limited to elevation data, satellite imagery, mapping services, and any other external data sources) that are not owned, operated, or controlled by Licensor (“Third-Party Services”). Licensor does not warrant and expressly disclaims all responsibility and liability for: (a) the availability, accuracy, completeness, reliability, or continued operation of any Third-Party Services; (b) any changes, restrictions, pricing changes, shutdowns, or termination of Third-Party Services by their providers; or (c) any failure, degradation, or unavailability of Software features that depend on Third-Party Services.
Any interruption, modification, or discontinuation of Third-Party Services shall not constitute a breach of the limited warranty in Section 6.1 and shall not entitle you to any refund, credit, damages, or other remedy under this Agreement.
6.4 No Responsibility for User’s Network Environment Licensor is not responsible for, and provides no warranty or support regarding, the Licensee’s internet connectivity, firewall settings, proxy servers, VPN configurations, network restrictions, or any other aspect of the Licensee’s local or corporate network environment. Any failure of the Software to connect to online services or download data that results from such issues does not constitute a defect in the Software and does not entitle Licensee to any remedy, refund, or support obligation.
6.5 No Obligation to Disclose Service Details Licensor is under no obligation to provide, publish, or maintain a list of URLs, IP addresses, domains, ports, or third-party services that the Software may connect to, or download from. Configuring firewalls, proxies, or network policies to allow the Software to function is solely the Licensee’s responsibility. Please contact support if you require extended support services.
6.6 No Guarantee of Updates, Compatibility, or Platform Availability Licensor is under no obligation to:
- provide updates, upgrades, bug fixes, or new features after the initial Maintenance & Support period expires;
- ensure the Software remains compatible with any future, past, or specific version of Maxon Cinema 4D or any other host application;
- maintain or supply builds of the Software for any particular operating system (Windows, macOS) or hardware architecture (Intel, Apple Silicon, etc.);
- continue offering the Software for sale or download indefinitely.
7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) IN NO EVENT WILL LICENSOR’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THIS AGREEMENT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM. (b) LICENSOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY.
8. Indemnification You agree to defend, indemnify, and hold harmless Licensor and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from (a) your use of the Software in violation of this Agreement or applicable law, or (b) your violation of any third-party rights in Third-Party Content.
9. Intellectual Property Infringement THE SOFTWARE IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OF NON-INFRINGEMENT. LICENSOR MAKES NO REPRESENTATION AND DISCLAIMS ALL LIABILITY REGARDING WHETHER THE SOFTWARE OR ITS USE INFRINGES ANY THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USE OF THE SOFTWARE DOES NOT INFRINGE THE RIGHTS OF ANY THIRD PARTY. IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY COSTS, DAMAGES, OR LEGAL FEES ARISING FROM ANY THIRD-PARTY CLAIM OF INFRINGEMENT.
10. Export Control & Government Use You will comply with all applicable export and re-export control laws. For U.S. Government end users: the Software is “Commercial Computer Software” under DFARS 252.227-7014.
11. Privacy Use of the Software may involve collection and processing of limited technical data (license key, IP address, Cinema 4D version, etc.). Such processing is governed by Licensor’s Privacy Policy available at https://cinemaplugins.com/contact/cookies/. Licensor complies with applicable data protection laws, including DSGVO (GDPR) for EU residents.
12. Governing Law & Dispute Resolution This Agreement is governed by the laws of the Federal Republic of Germany (Bundesrepublik Deutschland). Any dispute arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in [e.g., Berlin] (or your registered location in Germany).
13. Miscellaneous 13.1 Entire Agreement – This Agreement is the complete agreement and supersedes all prior agreements. 13.2 Amendments – Licensor may amend this Agreement by posting a revised version; continued use after posting constitutes acceptance. 13.3 Severability – Invalidity of any provision does not affect the remainder. 13.4 No Waiver – Failure to enforce any right is not a waiver. 13.5 Assignment – You may not assign this Agreement without Licensor’s written consent; Licensor may assign freely. 13.6 Force Majeure – Neither party is liable for delays caused by events beyond its reasonable control.
